Terms of Use

The short version: ShoreWindow is a planning aid for the shore. Your records are yours, subscriptions renew through Apple until you cancel, and the times it shows are modelled predictions — not for navigation, and the app does not assess access or sea safety.

1. Agreement to these terms

By downloading or using ShoreWindow (“the app”) you agree to these terms. If you do not agree with them, please do not use the app. The app is published by Trueframe Digital.

2. Licence

We grant you a personal, non-exclusive, non-transferable licence to use ShoreWindow on devices you own or control, in line with the rules of the store you obtained it from. You may not resell, redistribute, rent out, decompile or reverse-engineer the app except where the law expressly allows it.

3. Not for navigation, and not a safety judgement

ShoreWindow shows modelled predictions. Tide heights and times are computed from published harmonic constants for a nearby tide station, and sun, moon, weather and wave figures come from forecasts and public data sources. Real water differs from prediction — weather, surge, wind, river flow, local topography and gauge error all move it.

The app is not for navigation. It does not assess access or sea safety. A window shown in the app means the conditions you asked for are predicted to occur — never that a shore is safe, reachable, legal to enter, or clear of a cut-off risk. Rising water, soft ground, cliffs, currents, private or protected land and closed access are all outside what the app can see. Always use official charts and tide tables for navigation, obey local signage and authorities, and use your own judgement on the day.

The “Checked against official tide tables” badge means only that a particular station's predictions were compared against published tables for accuracy. It is not an endorsement by any hydrographic office or data provider, and it says nothing about safety.

4. Your data is yours

Everything you save stays on your device. We do not hold a copy and we cannot recover it for you. Backup and export are free and always available in the app, and keeping a backup is your responsibility — a lost, wiped, broken or stolen device means the records on it are gone. 5. ShoreWindow Pro, subscriptions & purchases

The app is free to use, and the free tier always shows the next matching window for your saved shore. ShoreWindow Pro is optional and is sold as a yearly subscription, a monthly subscription, or a one-time Lifetime purchase. All three unlock the same Pro features described on the purchase screen.

Subscriptions are billed through your Apple ID and renew automatically at the end of each period unless you turn auto-renew off at least 24 hours before it ends. Your account is charged for renewal within 24 hours of the period ending, at the price shown for your country. You can manage or cancel a subscription, and turn off auto-renew, in your Apple ID account settings at any time; cancelling takes effect at the end of the current period. Where a free trial is offered, any unused part of it is forfeited if you buy a subscription during the trial. Lifetime is a one-time purchase — it is not a subscription and it does not expire.

Purchases are processed by the App Store and are governed by that store's terms as well as these. Refunds are handled by Apple under its policy — we cannot issue them ourselves. Pro is tied to the Apple ID that bought it; Universal Purchase and Family Sharing apply. Prices may change for future purchases and for future subscription periods (Apple will notify you and ask for consent where its rules require it); a Lifetime purchase already made is not affected.

Your use of the app is also governed by Apple's standard End User Licence Agreement for licensed applications, at apple.com/legal/internet-services/itunes/dev/stdeula, except where these terms say otherwise.

6. Third-party data

Tide station data, weather forecasts, wave forecasts and live gauge readings come from third-party and public sources, including national tide-gauge operators and forecast providers, and are used subject to their own terms. That data may be incomplete, delayed, out of date or wrong, and coverage varies by place. We do not warrant it, and neither we nor those providers endorse how you use it. The app names the station, provider and datum behind every figure so you can check the source yourself.

7. Acceptable use

Use the app lawfully. Do not attempt to interfere with it, work around a paid feature, or disrupt any service it connects to.

8. Intellectual property

The app, its name, its design and its content are owned by Trueframe Digital and protected by copyright and other rights. Your own records remain yours. Place names, spots and figures appearing in demonstration data or in marketing material are illustrative only. ShoreWindow is an independent product and is not affiliated with, endorsed by, or sponsored by any hydrographic office, government agency, forecast provider or data operator, and all trade marks belong to their respective owners.

9. No warranty

The app is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent the law permits. We do not warrant that it will be uninterrupted or error-free, or that any tide, sun, moon, weather or wave figure it displays is accurate, complete, current, or suitable for any particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, Trueframe Digital is not liable for any indirect, incidental or consequential loss, or for lost data, lost records, a wasted trip, or loss or injury arising from a decision you made using the app. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence. If you are a consumer, you keep all statutory rights available to you — including, in Australia, the guarantees under the Australian Consumer Law.

11. Apple App Store

These terms are between you and Trueframe Digital, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple is not responsible for addressing any claim you or a third party makes about the app, including product-liability, regulatory or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Governing law

These terms are governed by the laws of Victoria, Australia, without regard to conflict-of-law rules, and subject to any consumer protections that apply where you live.

13. Changes

We may update these terms as the app develops. Changes will appear on this page with a new “last updated” date, and continuing to use the app after that means you accept them.
